Account and Transaction Information

  • Identification Information. First and last name, date of birth, gender, email, phone number, address, government identification number (including Social Security Number, driver’s license number, passport number, or taxpayer identification number), and other information necessary to verify your identity, to comply with our regulatory obligations under financial or anti-money laundering laws, and which may be required for tax reporting purposes. For artists, this may also include your legal and professional name and/or furnishing entity.
  • Financial Information. Bank account information, routing number, or credit card information.
  • Transaction Information. Information about the transactions you make or attempt to make using the Service, such as the Song Tokens you purchase, sell, or attempt to purchase or sell, the prices and timestamps affiliated with those actions, and the names of other users you transact with.
  • Wallet. To access certain features of the Service, you may need to provide us with information related to your digital asset wallet (each, a “Wallet”). Please note that we will not host, custody, or take possession of your private key or the contents of the Wallet.

You are responsible for the accuracy of the Personal Data that you submit. You can choose whether you provide Personal Data to Us, but if you do not provide it to Us, We may not be able to offer certain features of the Service.

Social Data

In connection with Our social network platform, We may also collect:

  • Names of friends you choose to invite
  • Your public facing profile and optional avatar photo
  • Messages you send and receive or conversations made with other users
  • Audio, electronic, visual, and similar information
  • Usage Data (as defined below)

We may collect Personal Data, such as email address, phone number, or mailing address when you request information about Our Service, register for Our newsletter or loyalty program, request customer or technical support, apply for a job, or otherwise communicate with Us.


We may contact you to participate in surveys. If you decide to participate, you may be asked to provide certain information, which may include Personal Data.

Sweepstakes or Contests

We may collect Personal Data you provide for any sweepstakes or contests that We offer, including information needed for tax purposes. In some jurisdictions, We are required to publicly share information of sweepstakes and contest winners.

Identity Verification and Payment Processing

In accordance with the applicable law, We or Our service providers may obtain information about you from public databases, credit bureaus and ID verification service providers for the purpose of verifying your identity. Such information may include name, address, publicly available information, credit history, status on any sanctions lists maintained by public authorities, and other relevant data. We obtain such information to comply with Our legal obligations, such as anti-money laundering laws, and to prevent fraud. In some cases, We may process additional data about you to assess risk and ensure Our Services are not used fraudulently or for other illicit activities.

We may use some of the following third-party service providers, among others:

  • Wyre Payments, Inc. to assist with payments and verify your identity. In addition, Wyre may provide us with certain personal data it collects, such as your social security number, where necessary to fulfill tax or other compliance obligations.   • SardineAI Corp. to assist with payments and bank account transfers, to verify your identity, and to prevent fraud. Please review Sardine’s Terms and Conditions and Privacy Policy for more information on how Sardine collects and uses your personal data.
  • Plaid, Inc. to connect your Songchain account with your bank account, verify your bank account and verify certain bank account information. Information shared with Plaid is treated by Plaid in accordance with its Privacy Policy.
  • Stripe, Inc. to assist with credit card transactions, including identity verification and fraud prevention. Please review Stripe’s Privacy Policy for more information on how Stripe treats your personal data.

Blockchain Data

We or Our service providers may analyze public blockchain data to ensure parties utilizing Our Service are not engaged in illegal or prohibited activity under Our Terms of Service, and to analyze transaction trends for research and development purposes.

Other Sources

We may obtain information about you from other sources, including through third-party services and organizations. For example, if you access our Services through a third-party application, such as an app store, a third-party login service, or a social networking site, we may collect information about you from that third-party application that you have made available via your privacy settings.

Third-Party Social Media Services

Songchain may allow you to create an account and log in to use the Service through the following Third-party Social Media Services:

  • Google

If you decide to register through or otherwise grant Us access to a Third-Party Social Media Service, We may collect Personal Data that is already associated with your Third-Party Social Media Service’s account, such as your name, your email address, your activities, or your contact list associated with that account. Our Service may contain social media buttons, such as Twitter, Reddit, Instagram, or Discord, which might include widgets such as the “share this” button or other interactive mini programs. These features may collect your IP address and which page you are visiting on Our Service, and may set a cookie to enable the feature to function properly.   • To maintain legal and regulatory compliance: We are required to collect, use, and store your Personal Data such as verifying your identity in order to comply with legal, tax, and regulatory requirements, such as anti-money laundering laws across jurisdictions.
  • To contact you: To contact you by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application’s push notifications regarding updates or informative communications related to the functionalities, products, or contracted services, including the security updates, when necessary or reasonable for their implementation.
  • To provide you with news, special offers and general information about other goods, services and events which We offer that are similar to those that you have already purchased or enquired about unless you have opted not to receive such information.
  • To manage your requests: To attend and manage your requests to Us, and to provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve Our Service.
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
  • For internal administrative and auditing purposes.
  • To detect security incidents and protect against malicious, deceptive, fraudulent, or illegal activity, including, when necessary, to prosecute those responsible for such activities.
  • For business transfers: We may use your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about Our Service users is among the assets transferred.

Songchain’s processing of your Personal Data will not result in a decision based solely on automated processing that significantly affects you unless such a decision is necessary as part of a contract We have with you, We have your consent, or We are permitted by law to engage in such automated decision making.   • De-identified and Aggregated Information. We may use Personal Data and other information about you to create de-identified and/or aggregated information, such as de-identified demographic information, information about the device from which you access Our Service, or other analyses We create.
  • Share Content with Friends or Colleagues. Our Service may offer various tools and functionalities. For example, We may allow you to provide information about your friends through Our referral services. Our referral services may allow you to forward or share certain content with a friend or colleague, such as an email inviting your friend to use Our Service. In addition, we may offer incentives to you such as discounts or promotional items or credit in connection with these programs, wherein you provide your Personal Data in exchange for a reward, or provide Personal Data regarding your friends or colleagues (such as their email address) and receive rewards when they sign up to use Our Service. Your information, including Personal Data, is processed at Songchain’s operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of your state, province, country, or other governmental jurisdiction, including the United States, where the data protection laws may differ than those from your jurisdiction. We may share your Personal Data in the following situations:

  • With service providers and professional advisors: We may share your Personal Data with Service Providers to help provide the Service, to verify your identity and comply with legal and regulatory requirements, for tax reporting purposes, to monitor and analyze the use of Our Service, for payment processing, to contact you, and so Service Providers can fulfill their obligations to Us. We may also share your Personal Data with Our professional advisors such as Our legal representatives, tax advisors, or insurance brokers.
  • With affiliates: We may share your information with Our affiliates, in which case We will require those affiliates to honor this Privacy Policy. Affiliates include Our parent Songchain and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.

  • Advertising partners: We may share your Personal Data with third-party advertising partners. These advertising partners may use this information (and similar information collected from other services) for purposes of delivering personalized advertisements to you and others when visiting digital properties within their networks and for other advertising purposes within their networks.   • With other users: when you share Personal Data or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside. If you interact with other users or register through a Third-Party Social Media Service, your contacts on the Third-Party Social Media Service may see your name, profile, pictures, and description of your activity. Similarly, other users will be able to view descriptions of your activity, communicate with you and view your profile.

7. Analytics and Email Marketing


We may use third-party service providers to monitor and analyze the use of Our Service. For example, Google Analytics is a Web analytics service offered by Google that tracks and reports Website traffic. Google uses the data collected to track and monitor the use of Our Service. Note that you will continue to receive important transactional emails from Us.

8. Legal Bases for Processing Personal Data of European Data Subjects

If We are subject to the General Data Protection Regulation (“GDPR”) or the UK General Data Protection Regulation (“UK GDPR”), the legal bases for the processing of your Personal Data are:
